Conditions of Carriage

Applicability the provision set out and referred to in this consignment note shall apply to modes of transport used by DTDC for connection of consignments.

They also apply if the mode of transport as described on the face of this consignment note is contrary to the original contract between the parties or performed by one or more modes of transport which may not the defined mode of delivery of the consignment as agreed in this consignment note.

DTDC is a private carrier and its rights and liabilities are governed exclusively by the express terms set out herein below subject to the applicable laws this consignment note constitutes a binding contract between DTDC and the parties.

DTDC's RIGHT OF INSPECTION OF CONSIGNMENT

DTDC has the right but not the obligation to open and / or inspect any shipment consigned by the consignor to ensure that all the items are capable of carriage to the destination within the standard operating procedure and handling methods. DTDC does not warrant that any particular item to be carried is capable of carriage without infringing the law of any state of the country from / to or through which the item may be carried.

DTDC reserves the right to refuse the consignor not conforming to these terms and conditions without assigning any reasons whatsoever.

The parties are solely responsible for all / any payments levied by the government or any statutory body in respect of any consignment

The parties hereby declare that the consignment covered under this consignment note does not include any contraband / legally restricted / hazardous / flammable/ poisonous/ explosive /currency / jewelry / food coupon / share certificate or articles categorized as prohibited under the regulations of the IATA (International Air Transport Association).

DTDC shall have a general lien over all the consignments of the parties towards any dues payable to DTDC by the parties.

DTDC shall not entertain any warehouse booking & delivery unless the declaration form available with the concerned operating units is duly filled up along with the necessary enclosures and handed over to the concerned person.

The parties shall pay the freight and other charges at the time of booking or within the payment period stipulated in this consignment note in case of non –payment of the bill amount within the stipulated time the parties shall be liable for payment of interest at the rate of 2% per month the bills will be raised even if POD (Proof Of Delivery) copy is not submitted.

DTDC advises the parties to insure the goods handed over to DTDC for transportation under the consignor insurance. In the event of any loss DTDC shall provide COF (certificate of facts) on request. A COF charge of 0.2% on the invoice value shall be charged.

No claim shall be entertained by DTDC for any loss or shortage damage non-delivery / breakage / leakage / pilferage, etc. of the consignment unless a written claim is lodged within three (3) days from the date of delivery subject to the provisions under risk coverage or general liability clause of DTDC.

Value added services COD / TO PAY are provided at additional charges over and above the freight charges without any liability on ‘DTDC’s part whatsoever with respect to the original contractual obligations or payment terms between the consignor and consignee or any third party.

Risk Surcharge

What is risk surcharge?

It is a provision from the company for the benefit of the customer to protect against the transit risks when the goods are not insured by the consignor. The coverage is extended if the customer chooses to avail the provision by paying the stipulated risk coverage charges.

This should not be construed as insurance cover as risk surcharge cover will have only a limited liability on the part of the company subject to the terms and conditions laid out.

Applicability of risk surcharge

Risk surcharge is applicable to all Premium Express Services and consignments booked under services offered with airway bill series that begin with - D, E, V and W. However, products and consignments that are booked under 'Mentioned Piece' will only have Mentioned Piece charges as levied covering the risk.

    All consignments under VAS and D series should be complete with all relevant documents like invoice, Tax forms etc as applicable. It is the responsibility of the consignor to provide the necessary documentation. Any failure in this regard to comply with any of the terms and conditions laid down under the contractual terms of the carriage will make all liability clauses on part of the carrier null and void.

About KYC

KYC is an acronym for Know Your Customer which is a term used for identifying and verifying the identity and address of a customer.
In the context of the increasing number of offenses such as misuse of export promotion schemes, fraudulent availing of export incentives, unscrupulous imports, and duty evasion by bogus Importer Exporter Code (IEC) holders, etc., the Know Your Customer (KYC) guidelines have been put in place by the Ministry of Finance, Central Board of Indirect Taxes & Customs to ensure that they are not used intentionally or unintentionally by importers or exporters who indulge in fraudulent activities.

Obligations of Authorised Courier

An Authorised Courier shall :

Obtain an authorisation, from each of the consignees or consignors of the imported goods for whom or from whom such courier has imported such goods; or consignees or consignors of such export goods which such courier proposes to export, to the effect that the authorised courier may act as agent of such consignee or consignor, as the case may be, for clearance of such imported or export goods by the proper officer.

Provided that for import of documents, gifts and samples, and low value dutiable consignments for which declaration have been filed in, form-B or the Courier Bill of Entry-XI (CBE-XI), form C or the Courier Bill of Entry-XII (CBE-XII) or form-D or Courier Bill of Entry- XIII (CBE-XIII) respectively, the authorisation may be obtained at the time of delivery of the consignment to consignee subject to the production of consignors authorisation at pre-clearance stage and retention of authorisation obtained from the consignee for a period of one year or date of audit by customs, whichever is earlier.

DTDC Advisory: Important Updates on U.S. Tariff & Customs Changes

Effective August 29, 2025

Most shipments (B2B, B2C, C2C) entering the U.S. are now subject to duty and customs requirements where the only de-minimis value exception is for C2C Gift valuing up to 100 USD only.

1. Duty & Thresholds

  • $800 duty-free threshold removed – most shipments (B2B, B2C, C2C) are now dutiable.

  • Gifts under $100/day may remain duty-free if:

  • Shipper and consignee are both individuals.
  • Invoice clearly states "Unsolicited Personal Gift" / "Personal Gift".
  • Goods are marked/labeled as "Gift". Please mention "For Personal Consumption Only" in invoices.
  • Multiple shipments exceeding $100/day taxable, even if split into smaller consignments.

  • Effective duty will be applicable to existing tariff duty on the product + 50% additional duty as reciprocal tariff.

2. Documentation Requirements

  • Detailed product description mandatory – include what the product is, quantity, made of, intended use and country of origin.

  • HS Code mandatory: 6-10 digit HS Code required, depending on Network. When in doubt, provide 10 digits to cover all requirements. The US accepts 10 digit HSN.

  • Invoice Requirements:

  • Shipping term should preferably be FOB.
  • If freight/insurance included, show cost, freight and insurance separately.
  • Currency and true declared value must be stated clearly.
  • Fair value of the goods in invoice. — U.S. Customs has final authority.

3. Duty Payment & Clearance

  • Recipients or shippers must pay applicable duty.

  • If duty is not paid by shipper, then the consignee has to pay the applicable duty.

4. Additional Carrier-Specific Fees

  • UPS International Processing Fee (IPF): INR 219 per shipment from September 8, 2025: Applies to all UPS Worldwide Express services to the U.S.

The Customer confirms that he does not rely upon or claim any other terms, warrants, conditions or representations relating to the use of the services provided by DTDC.

Rights and liabilities of DTDC and the Parties are governed by the terms and conditions set out herein below and this constitutes a binding contract between DTDC and the Parties.

The Parties confirm that this Consignment Note is prepared either by the Sender or by a DTDC staff acting as agent under the instruction of the Parties and its contents are binding on the Parties.

The consignment note is issued strictly based on the declaration given by the parties at the time of booking. The Parties shall remain solely liable for any consequences arising out of any false or wrongful declaration.

The sender shall provide complete address of sender and recipient along with valid contact telephone numbers and correct Postal Index Number (PIN code). Any service failure arising out of any defect in such details shall be at the sole responsibility & risk of the parties.

The Parties agree that the services undertaken by DTDC under this Consignment Note are conditional on the Parties making payment of freight and all other charges payable in respect of the consignment.
